Commercial Painting Company Inc. v. The Weitz Company LLC ET AL

The Tennessee Supreme Court remanded this case, directing this court to determine whether the parties’ contractual waiver applied to punitive damages that were awarded in connection with a tort claim for intentional misrepresentation. We conclude that the contractual waiver in this case is not a bar to the punitive damages awarded for intentional misrepresentation. The trial court’s judgment on this matter is affirmed.
