Case Number
W2025-00779-COa-R3-CV
This appeal arises from claims of negligence and negligence per se stemming from a dog bite. The trial court granted summary judgment in favor of the plaintiff after the defendant failed to respond to the lawsuit. Nine months after the entry of the final order, the defendant filed a motion to set aside the judgment pursuant to Tennessee Rule of Civil Procedure 60.02. The defendant claimed that he had not been served, had not been aware of the lawsuit, and the facts upon which summary judgment had been granted were false. The trial court denied the motion to set aside. The defendant appeals. We affirm.
