A Hamblen County jury convicted the Petitioner, Thomas N. Allen, of premeditated first
degree murder, and the trial court sentenced him to life in prison. The Petitioner
unsuccessfully challenged his conviction by direct appeal, petition for post-conviction
relief, a petition for writ of error coram nobis, a federal petition for writ of habeas corpus,
and a petition for forensic DNA analysis. The Petitioner filed a second petition for forensic
DNA analysis, which renewed his request to test the skull, loose teeth, and hair of the
victim. The lower court summarily dismissed this petition based upon the fact that it had
previously ruled on this same DNA testing request. The Petitioner appeals, contending the
lower court erred. We affirm the trial court.
