Kenneth Merritt v. American Home Shield

The pro se plaintiff sued his home warranty company alleging various causes of action
after the cancellation of his home warranty contract. The trial court granted the defendant
partial summary judgment, finding that numerous claims asserted by the plaintiff were
barred by the statute of limitations. The only remaining claim, for breach of contract,
proceeded to a jury trial. At the close of the plaintiff’s proof, the trial court granted the
defendant’s motion for a directed verdict due to the absence of any proof regarding
damages. The plaintiff appeals. We affirm.
