In this matter, the Plaintiff, Steven J. Mulroy, in his official capacity as Shelby County District Attorney, files suit against the defendants, Jonathan Skrmetti, in his official capacity as Attorney General, and William Lee, in his official capacity as Governor of the State of Tennessee, seeking declaratory and injunctive relief. The Plaintiff alleges that Public Chapters 928 and 948 (the “Audit and Pro Tem Act” and the “Memphis Safe Task Force Accountability Act”) are unconstitutional. The Plaintiff’s core argument is that the Acts single out the Shelby County District Attorney with special requirements and external oversight not imposed on any other district attorney in Tennessee, thereby impeding his prosecutorial discretion and violating Article VI, Section 5, Article I, Section 8, and Article XI, Section 8 of the Tennessee Constitution.
